Diversion from prosecution

In some circumstances the Procurator Fiscal will decide to divert a case for social work intervention.

The person has to agree. If the outcome is positive it is likely that no further action is taken, i.e. that the case will not be heard at court.

The aim is to prevent further offending.

Diversion may be considered in cases involving young or first offenders, for minor offences or where there is no overriding public interest for a prosecution.
